The US Treasury Office cannot control foreign assets to restore or reunite sanctions against Tornado Cash, and the US Federal Court has ruled.
Austin Federal Court Judge Robert Petman He said In a ruling issued on April 28 that OFAC sanctions on the cash of the hurricane were illegal and that the agency “was permanently obligated to impose” sanctions.
Tornado Cash, led by Joseph Van Leon, sued the treasury, arguing that the addition of OFAC to the addresses of the platform’s smart contract to its citizens appointed in particular and the banned people (SDN) were “not compatible with the law.”
OFAC imposed the hurricane penalty on that in August 2022, accusing the auxiliary protocol in washing encrypted by the Lazaros group, Lazaros Group.
The agency dropped the platform from the sanctions list on March 21 and argued that the matter was “a discussion” after the court ruled in favor of Tornado Cash in January.
This last amended judgment prevents OFAC from canceling the Cash Cash or returning it to the blacklist.
Initially, the court refused to request a partial brief ruling and granted it in favor of the treasury. However, the fifth circle reflected the decision and ordered the lower court to submit a partial brief ruling to the plaintiffs, which led to the abolition of the sanctions.
In March, the Treasury argued that there was no need for the final court ruling in the case.

The group said that the Ministry of Justice was trying to keep software developers responsible for how others used their blog, which they argued as “not just ridiculous in principle, but it is a precedent that is likely to cut all the development of encryption in the United States.”
